1. About Us and These Terms
The website glowlaya.com (the "Site") and the GlowLaya online store are operated by BLYRIX LTD, a company registered in England and Wales, with its registered office at Office 7287, 58 Peregrine Road, Hainault, Ilford, Essex IG6 3SZ, United Kingdom ("GlowLaya", "we", "us", "our"). You can contact us at info@glowlaya.com.
These Terms of Service ("Terms") govern your use of the Site and any purchase you make from us. By using the Site or placing an order, you agree to these Terms, our Return & Refund Policy, our Shipping Policy and our Privacy Policy, which form part of these Terms. If you do not agree, please do not use the Site.
Please read Section 17 carefully if you live in the United States. It contains a binding arbitration agreement and a class action waiver that affect how disputes are resolved.
2. Eligibility
You must be at least 18 years old, or the age of majority where you live, to place an order. By placing an order, you confirm that you are buying for personal use and not for resale, and that the information you provide is true and complete. We may refuse or cancel orders that appear to be placed by resellers, distributors or for commercial purposes.
3. Our Products Are Cosmetic, Not Medical
GlowLaya products are cosmetic personal care devices intended for at-home beauty routines. They are not medical devices and are not intended to diagnose, treat, cure or prevent any disease or medical condition. Information on the Site, including product descriptions, routines, comparisons and customer stories, is provided for general information only and is not medical advice.
Results vary. Results depend on individual factors such as skin type, age, consistency of use and lifestyle. Any timeframes or results described on the Site are illustrative and are not a guarantee of any specific outcome.
Safe use is your responsibility. Before using any product, read and follow the instructions, warnings and contraindications supplied with it and shown on the Site. Do not use our products, or consult a doctor first, if you are pregnant or breastfeeding, have a pacemaker or other electronic or metal implant, have epilepsy, light sensitivity or a photosensitive condition, take photosensitizing medication, have a skin condition, broken or irritated skin, or any other medical condition, or have had recent cosmetic procedures. Stop using a product immediately and seek medical advice if you experience discomfort, irritation or any adverse reaction.
4. Product Information and Pricing
We try to describe and display our products accurately. However, colors, images and packaging may vary slightly from what is shown, and minor changes to design, accessories or specifications may occur without notice where they do not materially affect the product.
All prices are shown in US dollars (USD) unless stated otherwise. We may change prices, products and promotions at any time without notice. Price changes do not affect orders we have already accepted.
Errors. If a product is listed at an incorrect price or with incorrect information due to an error, we may cancel any order for that product, even after it has been placed or confirmed, and refund any amount paid. We will tell you if this happens.
Comparison prices, "compare at" prices and references to the cost of clinic or salon treatments are provided for general reference only and may vary by location and provider.
5. Orders and Acceptance
Your order is an offer to buy. The order confirmation email we send is an acknowledgement that we received your order, not an acceptance. A contract is formed only when we ship the product to you and send you a shipping confirmation.
We may refuse, limit or cancel any order at our discretion, including where: a product is unavailable; there is a pricing or product information error; we suspect fraud, unauthorized use of a payment method or abuse of promotions; the order exceeds reasonable personal quantities; or we cannot ship to the delivery address. If we cancel an order after payment, we will refund you in full.
We may limit quantities per product, per customer, per household or per order.
6. Payment
Payment is taken when you place your order, through the payment methods shown at checkout. You confirm that you are authorized to use the payment method you provide. Payments are processed by third-party payment providers, and we do not store your full card details.
Disputes and chargebacks. If you have a problem with an order, please contact us at info@glowlaya.com before contacting your bank or payment provider, so that we can resolve it. We reserve the right to dispute chargebacks that are unfounded or that conflict with these Terms or our Return & Refund Policy, and to provide evidence of delivery and of these Terms to the payment provider.
7. Shipping, Delivery, Duties and Taxes
We currently ship to the United States, Canada, the United Kingdom and the member states of the European Union. Shipping details, including estimated delivery times, are set out in our Shipping Policy and at checkout. Delivery times are estimates only and are not guaranteed. We are not liable for delays caused by carriers, customs, weather, strikes or other events outside our reasonable control.
Risk of loss passes to you when the product is delivered to the address you provided. Title passes to you when we receive full payment. You are responsible for providing a complete and accurate delivery address.
Duties and import taxes. Some orders ship from outside your country. Unless duties and taxes are expressly collected and shown as included at checkout, any customs duties, import taxes, VAT, GST, brokerage or handling fees charged by your country or by the carrier on delivery are your responsibility, and you are the importer of record. These charges are not refundable by us except where the law requires. If you refuse to pay these charges and the parcel is returned or abandoned, the refund rules in our Return & Refund Policy apply, and we may deduct the original shipping cost and any return fees.
8. Returns and Refunds
Returns, refunds, cancellations and claims for damaged, defective or incorrect items are governed by our Return & Refund Policy. Our 60-Day Guarantee is subject to the conditions set out in that policy.
9. Warranty Disclaimer
To the fullest extent permitted by law, the Site and all products are provided "as is" and "as available". Except as expressly stated in these Terms or in our Return & Refund Policy, we make no other warranties, express or implied, including implied warranties of merchantability, fitness for a particular purpose, non-infringement, or that the Site will be uninterrupted, secure or error-free.
Nothing in these Terms excludes or limits any warranty or right that cannot be excluded or limited under applicable law, including your statutory rights as a consumer in the UK or EU in relation to goods that are faulty or not as described.
10. Limitation of Liability
To the fullest extent permitted by law:
- we are not liable for any indirect, incidental, special, consequential, exemplary or punitive damages, or for any loss of profits, revenue, data, goodwill or business opportunity, arising out of or relating to the Site, these Terms or any product;
- we are not liable for any injury, damage or loss caused by using a product contrary to its instructions, warnings or contraindications, by misuse, modification or unauthorized repair, or by using a product together with incompatible products or accessories;
- our total liability for any claim arising out of or relating to an order or product is limited to the amount you paid for that product.
Nothing in these Terms limits or excludes our liability for death or personal injury caused by our negligence, for fraud or fraudulent misrepresentation, or for any other liability that cannot be limited or excluded by law.
11. Indemnity
To the extent permitted by law, you agree to indemnify and hold harmless GlowLaya, BLYRIX LTD and its directors, employees and agents from any claims, losses, liabilities and expenses (including reasonable legal fees) arising out of your breach of these Terms, your misuse of the Site or any product, or your violation of any law or third-party right.
12. Acceptable Use of the Site
You agree not to: use the Site for any unlawful or fraudulent purpose; place false or fraudulent orders; interfere with the security or operation of the Site; use bots, scrapers or other automated means to access or copy the Site or its content; upload viruses or malicious code; or impersonate any person. We may suspend or block access to the Site, and cancel orders, if we believe you have breached these Terms.
13. Intellectual Property
All content on the Site, including text, graphics, logos, product names, images, videos, page designs and software, is owned by or licensed to GlowLaya and is protected by intellectual property laws. "GlowLaya" and our product names are our trade names. You may view and print pages for personal, non-commercial use only. You may not copy, reproduce, modify, distribute or use our content for commercial purposes without our prior written consent.
14. Reviews, Comments and Submissions
If you submit reviews, photos, videos, comments or other content to us or to the Site ("Submissions"), you confirm that they are your own, truthful and based on your genuine experience, and that they do not infringe anyone's rights or contain unlawful, offensive or misleading material. You grant us a non-exclusive, worldwide, royalty-free, perpetual license to use, reproduce, edit (for length and clarity only), display and distribute your Submissions, together with your first name and last initial, in connection with our business and marketing. We may remove any Submission at our discretion. We do not pay for, or offer incentives for, positive reviews.
15. Promotions and Discount Codes
Discount codes and promotions are subject to any conditions stated with them, cannot be combined unless stated, have no cash value, and may be withdrawn or changed at any time. We may cancel orders or reverse discounts obtained through error, misuse or abuse, including the use of multiple accounts.
16. Third-Party Services and Links
The Site may contain links to, or use services provided by, third parties (such as payment providers, carriers and social media platforms). We are not responsible for their content, policies or practices, and your use of them is at your own risk and subject to their terms.
17. Dispute Resolution
Contact us first. Most concerns can be resolved quickly by emailing info@glowlaya.com. Before starting any formal proceedings, you agree to contact us and give us at least 30 days to try to resolve the matter informally.
Customers in the United States: binding arbitration and class action waiver. If we cannot resolve a dispute informally, you and GlowLaya agree that any dispute, claim or controversy arising out of or relating to these Terms, the Site or any product will be resolved by binding individual arbitration administered by the American Arbitration Association under its Consumer Arbitration Rules, rather than in court, except that either party may bring an individual claim in small claims court if it qualifies. The arbitration may take place by video, by phone, based on written submissions, or in the county where you live. You and GlowLaya each waive the right to a jury trial and the right to participate in a class action, class arbitration or representative proceeding. Claims may be brought only on an individual basis. If the class action waiver is found unenforceable, this arbitration agreement will not apply to that claim. You may opt out of this arbitration agreement by emailing info@glowlaya.com with the subject "Arbitration Opt-Out", your name and your order number within 30 days of your first purchase. The Federal Arbitration Act governs the interpretation and enforcement of this Section.
Customers in the UK and EU. The arbitration agreement above does not apply to you. You may bring proceedings in the courts of England and Wales or in the courts of the country where you live. EU consumers may also use the European Commission's Online Dispute Resolution information and alternative dispute resolution bodies where available.
18. Governing Law
These Terms and any dispute or claim arising out of or in connection with them are governed by the laws of England and Wales, except for Section 17, which for customers in the United States is governed by the Federal Arbitration Act. If you are a consumer, this choice of law does not deprive you of the protection of mandatory consumer laws of the country where you live. Subject to Section 17, the courts of England and Wales have non-exclusive jurisdiction.
19. Events Outside Our Control
We are not responsible for any failure or delay in performing our obligations caused by events outside our reasonable control, including natural disasters, pandemics, war, terrorism, strikes, supplier or carrier failures, customs delays, government actions, or failures of internet or payment systems.
20. General
If any provision of these Terms is found invalid or unenforceable, the remaining provisions will continue in full force. Our failure to enforce any right is not a waiver of that right. You may not transfer your rights under these Terms without our consent; we may transfer our rights and obligations to another business. These Terms, together with the policies referred to in them, are the entire agreement between you and us regarding their subject matter.
21. Changes to These Terms
We may update these Terms from time to time by posting a new version on the Site. The Terms in effect at the time you place an order apply to that order. Your continued use of the Site after changes are posted means you accept the updated Terms.
